From July 11, 2023, in accordance with the adopted anti-tobacco law No. 1978-IX, a ban on advertising of electronic smoking devices (both electronic cigarettes and devices for heating tobacco) and a ban on the sale of flavored cigarettes and e-liquids comes into force.
In particular, the changes include a ban on the sale of:
tobacco products with aromatic additives (these are energy additives, vitamins, caffeine, taurine; additives that make smoke emissions colored), which could mislead consumers about the consequences of tobacco use.
cigarettes and rolling tobacco (in particular, filter, paper, the capsule of which contains tobacco or nicotine, or flavoring additives).
liquids with or without nicotine, which contain flavoring additives (in particular, with the taste of fruit, menthol or caffeine).
The ban on the production and sale of tobacco products, e-cigarettes and their liquids with additives entered into force on July 11.
However, producers will be able to sell off the remaining products during the year. The law provides for a fine of UAH 1,020 for their implementation by persons under the age of 18, and UAH 10,200 in case of repeated violations.
Advertising of tobacco products, electronic cigarettes and their liquids is also prohibited. The ban includes advertising both at points of sale and on the Internet." Advertising of such products on television or as sponsorship at public events is also prohibited.
In order for anyone who encounters a violation of anti-tobacco legislation to be able to report it and protect themselves and their loved ones, the Center for Public Health has created an online platform - nosmoking.phc.org.ua. There is an opportunity to file a complaint directly through the site, or through a mobile application or chatbots in Telegram and Viber messengers.
Using the nosmoking.phc.org.ua platform, citizens can report the following violations:
• smoking in restaurants, bars, cafes;
• smoking in public places, residential buildings, in transport;
• advertising of tobacco products;
• illegal trade in tobacco products;
• lack of warning information and presence of prohibited items for smoking.
According to Art. 19 of the Law of Ukraine dated September 22, 2005 No. 2899-IV "On measures to prevent and reduce the use of tobacco products and their harmful effects on the health of the population", state control over compliance with the provisions of this Law is carried out by the relevant central bodies of the executive power within the limits of the powers defined by law If administrative offenses are recorded, it is necessary to contact the National Police and the State Production and Consumer Service.
